Terms of Service

1. Acceptance of Terms

By accessing or using Mustard Seed Life ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

2. Service Description

Mustard Seed Life is a platform that lets parents create a page where family and friends guess when a baby will arrive and, if they choose, send a gift. Once a child is born, parents can open a giving page where family and friends can send a gift. Gifts are processed through Stripe Connect and paid to your connected account.

What you do with gifts you receive is up to you. We do not manage, hold, or invest funds on your behalf.

3. User Accounts

Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

Account Responsibilities

You are responsible for safeguarding your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to comply with this section.

4. Payment Processing

Stripe Connect

Payment processing is handled by Stripe Connect, a third-party payment processor. By using our Service, you agree to Stripe's Terms of Service and Privacy Policy. Stripe Connect enables direct transfers to your connected bank account.

We do not store or have access to your full payment card details, bank account numbers, or investment account information. All financial data is handled securely by Stripe.

Platform Fees

Our platform charges a fee of 1.5% of each contribution, in addition to Stripe's standard payment processing fees (2.9% + $0.30 per transaction). These fees are transparently disclosed before any contribution is processed.

All fees are deducted automatically during payment processing. You will receive the contribution amount minus these fees directly to your connected Stripe account.

Tax Reporting and Obligations

Receiving contributions through the platform may be subject to tax reporting. Payment processors or platforms may issue forms such as Form 1099-K when applicable thresholds are met in your jurisdiction.

You are responsible for understanding and satisfying your own tax obligations. Mustard Seed Life does not provide tax advice. We recommend consulting a qualified tax professional regarding reporting and tax implications of contributions you receive.

5. User Content and Conduct

Content You Provide

You retain ownership of any content you submit, post, or display on or through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content solely for the purpose of providing the Service.

Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Violate or infringe upon the rights of others
  • Transmit any harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without permission
  • Impersonate any person or entity
  • Collect or harvest information about other users

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Mustard Seed Life and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without our prior written consent.

7. Limitation of Liability

No Investment Advice: Mustard Seed Life does not provide investment, financial, legal, or tax advice. You are solely responsible for decisions regarding your child's investment accounts and should consult with qualified professionals.

No Guarantees: We do not guarantee that contributions will result in any specific investment returns or outcomes. Investment performance is subject to market risks.

Service Availability: We do not guarantee that the Service will be available at all times or that it will be error-free. We reserve the right to modify, suspend, or discontinue the Service at any time.

Limitation: To the maximum extent permitted by law, Mustard Seed Life shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

8. Indemnification

You agree to defend, indemnify, and hold harmless Mustard Seed Life and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

9. Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Mustard Seed Life operates, without regard to its conflict of law provisions.

Dispute Resolution Process

If you have any concerns or disputes about the Service, you agree to first contact us at support@mustardseedlife.com to attempt to resolve the dispute informally.

If we cannot resolve the dispute informally, you agree to resolve any disputes through binding arbitration or small claims court, as applicable in your jurisdiction.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us or using account deletion features in your account settings.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mustard Seed Life regarding the use of the Service and supersede all prior agreements and understandings.
